Terms & Conditions
1. Appointment
1.1. These Terms & Conditions apply to all quotations, invoices, and services provided by JAISELECT (Pty) Ltd (“JAISELECT”).
1.2. By accepting a quotation or allowing work to commence, the Client agrees to be bound by the provisions contained herein.
2. Scope of Services
2.1. JAISELECT will supply the products and/or perform the services described in the quotation issued to the Client.
2.2. Any work or materials not specifically included in the quotation will be treated as additional and charged separately.
2.3. Timelines provided are estimates and may be adjusted due to availability of materials, weather conditions, access issues, or other factors beyond our control.
3. Client Responsibilities
3.1. The Client must provide reasonable access, information, approvals, and cooperation required for JAISELECT to complete the work.
3.2. Delays caused by lack of access, late decisions, or failure to provide necessary information may result in revised timelines and/or additional charges.
4. Pricing and Variations
4.1. All quotations are based on current material and labour costs at the time of issue.
4.2. If material prices increase during the project, JAISELECT reserves the right to adjust the final invoice accordingly.
4.3. Any requested variations must be confirmed in writing and may impact pricing and completion dates.
5. Deposit and Payments
5.1. A 70% deposit is payable upon acceptance of the quotation. Work will not commence until the deposit has cleared.
5.2. The remaining balance is due immediately upon completion of the work.
5.3. Interest of 2% per month will be charged on all overdue accounts.
5.4. Payments must be made free of bank charges, without deductions or set off.
5.5. JAISELECT may suspend work if any payment becomes overdue.
6. Ownership and Risk
6.1. All goods, materials, designs, and completed work remain the property of JAISELECT until full payment is received.
6.2. Risk in delivered materials transfers to the Client upon installation or delivery to site.
7. Subcontractors
7.1. JAISELECT may appoint suitable subcontractors where necessary, but remains responsible for the overall quality and performance of the project.
8. Warranty
8.1. JAISELECT warrants that all work will be carried out in a professional and workmanlike manner.
8.2. Defects attributable to workmanship must be reported within 7 days of completion.
8.3. Warranty excludes:
- misuse or negligence
- fair wear and tear
- third-party interference
- client-supplied materials
- events beyond JAISELECT’s control
9. Liability
9.1. JAISELECT is not liable for indirect, consequential, or financial losses such as loss of profits, business interruption, or delays caused by suppliers.
9.2. JAISELECT is not responsible for damage caused by hidden conditions, structural issues, inadequate installations by previous contractors, or factors beyond its control.
9.3. The Client indemnifies JAISELECT against claims arising from conditions on-site not disclosed by the Client.
10. Cancellation
10.1. If the Client cancels after work has commenced or after accepting the quotation, the deposit is non-refundable.
10.2. The Client is liable for all costs incurred up to the time of cancellation.
11. Force Majeure
11.1. JAISELECT is not liable for delays or failures caused by events outside its reasonable control, including but not limited to strikes, supplier delays, ‘lockdowns’, extreme weather, or government actions.
12. Notices
12.1. Official correspondence may be delivered to the email or physical address supplied in the quotation or invoice.
12.2. Either party may change its address for notices by written communication.
13. Governing Law
13.1. These Terms & Conditions are governed by the laws of the Republic of South Africa.
14. Acceptance
14.1. By accepting the quotation and/or allowing work to commence, the Client acknowledges that they have read, understand, and agree to these Terms and Conditions.
